c
y
•~
RIGHT-OF-ENTRY AGP,EEMENT
THIS AGREEMENT is made and entered into this ~~ day of
October, 1983, by and between HAROLD H. MOLLER and LLOYD M.
MOLLER (hereafter "Property Owner") and the CITY OF PLEASANTON,
a municipal corporation, (hereafter "City").
RECITALS
1. Harold H. Moller, Evelyn B. Moller, Lloyd M. .Moller and
Roy J. Moller and City entered into an agreement dated.
February l3, 1979 (Exhibit "A") pursuant to which City purchased
certain property to construct a water reservoir and an easement
for roadway purposes to reach the-reservoir site.
2. City now desires to construct a larger reservoir on
the site than originally planned and desires to acquire additional
property in order to accommodate the larger reservoir.
3. City further desires to begin construction on the
access roadway and reservoir as soon as possible in order to
complete enough. site improvements to enable. construction to
proceed through the winter.
4. Because the property sought to be acquired by City
is subject to, certain probate proceedings, City cannot expeditiously
acquire the additional property necessary, and, accordingly, City
seeks a right-of-entry to enable construction to begin prior
to the resolution of probate proceedings and final resolution
of the .acquisition.

-1-
