HANSEN <br />and ANN MARIE MIX (jointly 11Owners") and PONDEROSA HOMES, a <br />general partnership ("Ponderosa'°). <br />RECITALS <br />A. City, Owners and Kaiser Aetna, a general partnership <br />now dissolved and the predecessor in interest to Ponderosa, made <br />an agreement on November 22, 1972, recorded'on August 9, 1972 as <br />Instrument No. 72-108417, Reel 3202, Image 27, et seq., in the <br />Official Records of Alameda County ("Agreement") respecting cer- <br />twin real property described in-the Agreement ("Real Property"). <br />B. Ponderosa has purchased from Owners a portion of the <br />Real Property, which portion is described on Exhibit "A" attached <br />hereto and made apart hereof by reference ("Ponderosa Property"}. <br />Ponderosa desires to terminate the effect, if any, of the Agree- <br />went with respect to the Ponderosa Property and the City and <br />Owners agree. <br />AGREEMENT <br />1. City, Owners and Ponderosa agree that, with respect to <br />the Ponderosa Property, the Agreement is terminated, cancelled, <br />..deemed of no further force or effect, and the obligations of the <br />Agreement no longer a covenant running with the Ponderosa Property. <br />2.
