Owner <br />further agrees to cooperate with City in the annexation of the lands <br />described herein, whether alone or as part of the larger area, and <br />expressly waives the right to protest said annexation and agrees to <br />do no act calculated or tending to prevent, impede, or defeat the <br />successful annexation of said property. <br />3. Land Subject to This Agreement. The land subject to this <br />.agreement shall be those lands of Owner more particularly described in <br />the legal description and map attached hereto as Exhibit A and made a <br />part hereof. <br />4, Bonded Debt. Owner does hereby consent that, upon annexation <br />of his-property to City, said property shall be taxed to pay its share <br />of existing bonded indeb~tednes of City. This agreement shall serve as <br />such consent, and a copy shall be filed with the Treasurer-Tax Collector <br />of Alameda County, if evidence of such consent is required; provided, <br />however, the Owner's property will be excluded from the City bonded <br />debt existing an the effective date of this agreement and from and <br />after the annexation of his property to City for all utility facilities <br />to which.Owner'sproperty is nat connected. <br />5. Taxes. Owner understands that .after annexation has been <br />completed, said property shall be subject to all-real property taxes. <br />6. Assessment Districts.. Owner agrees to cooperate with City <br />in the formation of any mutual benefit districts or assessment districts <br />which City deems necessary for the installation of public improvements <br />serving, in whole or in part, Owner's lands as described herein, whether <br />such districts are formed at the time of annexation or some time in the <br />- 3- <br />
