Final amount to be paid by Property Owner shall be deter- <br />mined by actual quantities and unit prices paid by City <br />.for Property Owner's portion of sanitary sewer facilities <br />plus an additional ten percent for engineering costs.. In <br />the event the deposit based on the estimated construction <br />costs is greater than the actual costs, City shall, within <br />45 days after acceptance of the improvements, refund to <br />Property Owner the difference between estimated and actual. <br />costs. In the event the deposit is less than actual costs, <br />Property Owner shall, within 45 days after receipt of tab- <br />ulation of final costs, reimburse to City the difference <br />between estimated and actual. costs.. <br />4. Should legal action be necessary to enforce. the provisions <br />hereo, the party in whose favor judgment is granted shall be en- <br />titled to reasonable attorneys fees in conjunction therewith. <br />5.This agreement shall be a covenant which is to run with <br />the land and be binding upon the heirs, successors and assigns of <br />the parties hereto and may be recorded in the Office of the Recorder <br />o'f Alameda County by either party hereto. <br />The parties hereto set their signatures to this agreement as <br />of the-.date first written above. <br />ATTE "' ; <br />Clayt a_E.
