• <br />20 <br />• <br />Arbitration. ny disputes regarding the interpretation, effects, alleged breach or <br />powers and uties arising out of this Agreement will be submitted to binding <br />arbitration. n arbitration panel of three (3) individuals shall be formed as follows: <br />a) Each T ird Party Beneficiary and ABAG POWER shall have the right to submit <br />the na a and qualifications of an individual nominated for the panel. The <br />individ al shall be a member in good standing of the State Bar of California. <br />ABAG OWER will compile a list of all such names, with the names of those <br />submit ed more than once, appearing as many times as they were submitted <br />(List). <br />b) Each T ird Party Beneficiary which submitted a name and ABAG POWER, if it <br />.submit ed a name, shall have the right to strike a name from the List. The <br />order i which the Third Party Beneficiaries and ABAG POWER shall strike <br />names hall be determined by lot. <br />c) The striking process shall continue until only the names of three (3) qualified <br />individ als are left.
