PUBLIC IMPROVEMENT AGREEMENT THIS AGREEMENT made and entered at Pleasanton, California, this ~~~ day of ~_, 2002, by and between: Frank Auf der Maur Surviving Trustee of The Frank Auf der Maur and Alma Auf der Maur Trust Dated April 17, 1985 Konrad Dominik Rickenbach, Trustee of the Konrad D. Rickenbach and Elizabeth Y. Rickenbach 1987 Trust dated March 13, 1987 Elizabeth Y. Rickenbach, Trustee of the Konrad D. Rickenbach and Elizabeth Y. Rickenbach 19887 Trust dated March 13, 1987 (hereinafter referred to as "Developer") and the CITY OF PLEASANTON, a general law city, located in Alameda County, California, acting through the City Manager and the City Clerk, (hereinafter referred to as "City"). WHEREAS, Developer has Improvement Plans for Parcel Map 7885 located at Bernal Avenue and Del Valle Parkway, lying within the boundaries of the City; duly approved by the Planning Commission or the City Council; and WHEREAS, Developer has presented improvement plans entitled "Improvement Plans for Parcel Map 7885 City of Pleasanton, Alameda County, CA" designed by Alexander and Associates, reviewed by the City Engineer's office in October 2002, a copy of which is on file in the office of the City Engineer, and by reference is included in this agreement for all purposes as if attached hereto, and WHEREAS, pursuant to the MS-O1-10 conditions of approval, Developer is required to construct and pay for the improvements described in such plans as provided in the MS-O1-10, and WHEREAS, said plans designate construction of Public Improvements, that the Developer intends to dedicate to the City, and WHEREAS, as a condition precedent to accepting this offer of dedication by Developer, City requires the improvements of the public ways, installation or extension Public Improvement Agreement 10/23/2002 Auf der Maur/Rickenbach, PM 7885 Page 1 of 9
