RECITALS A. The City and Property Owners entered into the Agreement regarding the commercial development of Property Owners' approximately 30.05 acres of property (the "Property"), and the immediate construction of the Bernal Avenue extension through the Property. B. Since the completion of the Bernal Avenue Extension as contemplated in the Agreement, the traffic congestion at the intersection of Bernal Avenue and Stanley Boulevard has significantly increased. C. The Agreement had provided for the dedication and construction by the Property Owners of a deceleration lane at Stanley Boulevard along the frontage of their property at Lot 8 and Lot 9 of Parcel Map 5814 in conjunction with the development of the Property. D. The City desires to have the right-of--way for the deceleration lane dedicated at this time to allow for immediate construction of the deceleration lane, rather than waiting for the dedication to occur in conjunction with development of the Property. E. Furthermore, the City requires additional right-of--way along the Stanley Boulevard frontage of the Remainder Parcel of Parcel Map 5814 in order to complete road- widening for improved traffic circulation. F. The Property Owners agree to such an immediate dedication of right-of--way in exchange for the City amending the Agreement to allow for vehicular .access from Stanley Boulevard into Lot 8 and Lot 9 at one access point, and for City construction of the deceleration lane at the City's cost. ~::~ ~.., .j,- :,;:nom _.~$~ .. _<; L.. .;a ti ~,.
