<br />• <br />the remaining provisions of this Agreement shall not be <br />affected thereby. <br />10.14. Reliance. No investigation or inquiry <br />made. by or on behalf of any party hereto shall in any way limit <br />such party's right to rely on the warranties and <br />representations made to such party in this Agreement. <br />10.15. Binding Effect. This Agreement shall be <br />binding upon and inure to the benefit of the heirs, successors, <br />executors, and, to the extent permitted by Section 13.2, <br />assigns of the parties. <br />10 16. Venue. All claims pertaining to or <br />arising out of this Agreement shall be litigated in the State <br />of California, County of Alameda Superior Court or the United <br />States District Court for the Northern District of California, <br />in San Jose, California. <br />10.17. Delivery of Documents. Notwithstanding <br />any other term of this Agreement to the contrary, Seller shall <br />have no responsibility or liability whatsoever to deliver to <br />Buyer and/or Escrow Holder any contracts, agreement, permits, <br />documents, instruments or other matters which are not in <br />Seller's .possession or under Seller's control. <br />10.18 Agreement in lieu of Condemnation.
