2. Property subject to agreement. The property which is the subject of this Agreement is described in Exhibit "A". 3. Landscaping Plan. Reference is made to the Planning Corn- mission proceedings of September 14 19 83 and the landscaping plan which, by Cohdition 3 of the Board of Adjustment approval is to be (has been) approved by the Planning. Department.. Copies of said landscaping plan will. be (is) kept on file with the City in the office of the Planning Director, Civic Center, 200 Bernal Avenue, Pleasanton, California. 4. Landscaping as a benefit. Property. owner agrees that the. landscaping which he is obligated to provide will materially .benefit his property and it is necessary to comply with the Board of Adjustment approval conditions imposed by the City as a require- ment of the development of the property, as shown in Resolution R-83-21. incorporated by reference herein and attached hereto as Exhibit "B". 5. Duty to maintain landscaping. Property owner agrees to diligently maintain and .care for the landscaping which he installs, using generally accepted methods far cultivation and watering. Pro- perty owner shall maintain that standard of care necessary to prevent the landscaping from deteriorating to the extent. that its value as landscaping is destroyed. 6. City may maintain landscaping. Property owner agrees that if he fails to meet the standard of maintenance necessary to keep the landscaping in a healthy condition, the City may elect to take the steps necessary to assure that the landscaping is maintained and cared for.
