• • 2.2 Contribution to Capital Fund. Caroline shall pay to the City on April 15, 1931 or upon the. date the "additional sewer capacity" described in paragraph 2.3 hereof is constructed and is available for use (whichever occurs later), cash in the amount of One Hundred Thousand Dollars (.$100,000.00) as a contribution to the capital fund of the City. 2.3 Surcharge for Industrial Capacity and Sewer Connection Fees. Caroline agrees to pay a surcharge pursuant to the formula contained in Exhibit "B" to this agreement, in addition to all regular sewer connection fees payable at the time of connecting any structure or building to the sewer .system, for the portion, if any, of said"additional sewer::. capacity" actually used by Caroline (. or his successor) on Tract 4326. The surcharge may be paid in advance to reduce carrying charges, at Caroline's option. 2.4 Other Capacity. Caroline may apply for and purchase sewer connections for Tract 4326 in accordance with the city's standard requirements and procedures utilizing whatever current sewer capacity exists until such time as the sewer capacity to be created pursuant to the Willow West Agreement (.500,000 GPD) becomes available for use by Caroline. Upon notification of the availability of that capacity, Caroline agrees not. to apply for or purchase any other sewer capacity beyond the allocation provided in this agreement until such allocation is exhausted. The limitations on the use of the 500,000 GPD capacity created by the Willow West Agreement shall not apply to any. regular capacity purchased prior to the availability of the said 500,000 GPD. _4_
