4 . <br />PUBLIC IMPROVEMENT AGREEMENT <br />OAKHILL SHOPPING .CENTER <br />PLEASANTON <br />AMENDMENT NO. 1 <br />THIS AGREEMENT is made and entered into at Pleasanton, <br />California, this 18th day of October, 1988, by and between <br />PLEASANTON C & R ASSOCIATES <br />a California Limited Partnership <br />CONNOLLY DEVELOPMENT, INC. <br />General Partner, <br />(hereinafter referred to as "Developer") and THE CITY OF <br />PLEASANTON, a municipal corporation (hereinafter referred to <br />as"city"). <br />R E C I T A L S <br />A. On April 7, 1988, the parties entered into a <br />written Agreement For Public Improvements. <br />B. The parties desire to modify that Agreement For <br />Public Improvements by adding Paragraph 18. <br />IN CONSIDERATION of the promises contained herein and in <br />the original agreement of April 7, 1988, the parties agree as <br />follows: <br />1. Paragraph 18 shall be added as follows: <br />"18. Contribution in Lieu of Sunol Boulevard <br />Widening. The Developer shall contribute Two <br />Hundred Twenty-three Thousand Nine Hundred <br />Dollars ($223,900.00) for its share of <br />widening costs of Sunol Boulevard, which <br />includes construction of traffic signals at <br />Junipero Street and Mission Dive, construction <br />of traffic islands on Sunol Boulevard, <br />restriping of Sunol Boulevard, and utility <br />pole and drainage ditch relocation parallel to <br />Sunol Boulevard." <br />2. All terms, conditions, and provisions of the <br />original agreement dated April 7, 1988, except as modified in <br />this agreement, is otherwise reaffirmed. <br />Page 1 <br />
