<br /> <br />ALTE~NATTVE TRAFFIC M1T1GA'1'1t7N MEASURES AG12EE1V1LT~TT <br />THIS AGREEMENT is made and entered into on the 14 th day of Sept. , 1998, by and <br />between CRANBERRY MANUFACTU.kziNG COMPANY ("CMC" or "Property Owner") a.nd <br />the C1TY Oh PLEASANTON, a municipal corporation ("City"), <br />RECITALS <br />A. Property Owner is the owzaer of real property ("the Subject :Propert}~") in the City <br />of l~leasanton, which property is located at 6675 Owens drive, Pleasanton, California. <br />B_ The Subject Property has a Planning Co7mrnission approved design plan Case <br />Z-97-143. <br />C_ Certain conditions of approval for Case Z-97-143 require that the Property Owner <br />pay its .fa.ir share of any alternative traffic mitigation measures designed to mitigate lorrg-term <br />traffic Levels-af Service (LOS) on north Pleasanton freeway interchanges, streets, and/or <br />intersections wit11 or without the I-684/West Las Positas Boulevard freeway interchange. <br />D_ The cost of such measures, and the Property Owner's fair share thereof axe not <br />known at this time. <br />NOW, 'I`FIEREFORE, in consideration of the following pronuses, the parties agree as <br />follows: <br />1. Property Owner's Obligation. The Property Owner shall pay its fair sE~are of any <br />alternative traffic mitigation, measures designed to mitigate long-term tragic Levels~of-Service <br />(LOS) on north Pleasanton freeway interchanges, streets, and/or intersections with or without the <br />I-680/West I,as t'ositas Boulevard freeway interchange. <br />2. No Guarantee, City does not guarantee that existing LOS standards will be <br />maintained in perpetuity and does not guarantee that it will be responsible for keeping north <br />Pleasantarr streets, intersections, and freeway entrance/exit ramps at LQS "D" or better. <br />3. Transportation Sy •ts ems Management Program. Property Owner recognizes the <br />City's preference co imple~T~ent a proactive Transportation Systems Management prograrzi, or <br />other measures as maybe required by the City Council, to mitigate the PiJ"D plan's anticipated <br />traffic impacts. <br />4, Notice.
