Owners a o ate a y <br />maintenance of the waterline only after the City Council has accepted the public improvements <br />within Tract 5927. The Developer and all subsequent owners of the Property shall have the right <br />to connect and use said improvements only in accordance with the City's regulation of water <br />usage. <br />4. Developer's Share. Developer's share of the cost of the water mainline and any <br />related improvements shall be deemed contributed upon the completion of construction and the <br />acceptance of the water mainline by the City Council, subject to reimbursement as herein <br />provided. <br />5. Payment. The City shall pay the reimbursement to Developer after the City <br />Engineer's approval of the actual material costs, and within 30 days of the City Council's <br />acceptance of the water mainline. The Developer's right to reimbursement shall be personal to <br />Developer and shall continue notwithstanding subsequent sale or transfer of the Property or <br />portions of the Property. Developer shall have the right to assign its interest to the <br />reimbursement fee to another person or entity at any time by providing City written notice of <br />such assignment. <br />Developer hereby directs that reimbursement shall be payable to the following: <br />Mr. and Mrs. Robert D <br />P. O. Box 2388 <br />Livermore, CA 94550 <br />and Shirley M.
