'~ <br />FINANCING ADMINISTRATION AGREEMENT <br />This Agreement, entered into this 5th day of December, 2000, by and <br />between the City of Pleasanton, a municipal corporation of the State of California <br />("City") and the Dublin San Ramon Services District, a public entity ("District"); <br />WITNESSETH: <br />WHEREAS, District owns and operates certain wastewater treatment and <br />pretreatment facilities; and <br />WHEREAS, City provides wastewater collection and transmission <br />services for wastewater emanating from City's local wastewater service area; <br />and <br />WHEREAS, City and District, entered into that certain "Regional <br />Agreement" (hereinafter defined) pursuant to which District receives and treats <br />wastewater emanating from City's wastewater service area; and <br />WHEREAS, City and District are member agencies of the Livermore- <br />Amador Valley Water Management Agency ("LAVWMA"; hereinafter more <br />particularly defined) which receives, transports, and disposes of treated <br />wastewater emanating from its member agencies' wastewater service areas; and <br />WHEREAS, District has undertaken expansion of its treatment facilities, <br />the financing of which has been provided by the issuance of bonds; and <br />WHEREAS, LAVWMA proposes to repair and expand its wastewater <br />export and disposal facilities through the issuance of bonds or other evidences of <br />indebtedness (collectively, "Bonds"); and <br />WHEREAS, Regional Connection Fees and Regional Services Charges <br />(which fees and charges are hereinafter defined) and other revenues attributable <br />to the operation of District's facilities have been, and shall be, pledged as <br />Agmt-41 <br />f/sh/sh/DSRSD <br />DES:rg <br />12/5/OOr <br />
