MUTUAL GENERAL RELEASE <br />DUBLIN SAN RAMON SERVICES DISTRICT, successor in <br />interest to Valley Community Services District, a public agency <br />of the State of California ("District"); VOLK-McLAIN PROPERTIES, <br />a limited partnership, successor in interest to VOLK-McLAIN <br />COMMUNITIES, INC., a California corporation, ("Volk-McLain"), for <br />consideration received pursuant to provisions of the Settlement <br />Agreement heretofore entered into by said parties hereby enter <br />into this Mutual General Release. <br />A. Dublin San Ramon Services District, successor in <br />interest to Valley Community Services District, is plaintiff, <br />cross-defendant and respondent and Volk-McLain Properties, a <br />limited partnership, is defendant, cross-complainant and appellant <br />in that certain case entitled, "Valley Community Services District <br />v. Volk-McLain Communities, Inc., et al, and Volk-McLain <br />Properties, cross- complainant v. Valley Community Services District, <br />cross-defendant", No. 441299 in the Superior Court of the State <br />of California in and for the County of Alameda. <br />Judgment was entered in favor of District and against <br />Volk-McLain on October 26, 1976, and the aforesaid appeal is <br />currently pending. <br />B. District and Volk-McLain hereby release and dis- <br />charge each other and their respective and present and former agents, <br />servants, employees, independent consultants, elected officials and <br />attorneys from any and all claims, demands and/or causes of action <br />known, unknown or suspected and do hereby waive the provisions of <br />~Yf~IGl7~ A <br />
