Termination A. This agreement may be terminated at any time by the mutual consent of the City and the Developer. B. This agreement may be terminated by the Developer effective the end of any calendar month with not less than 30 days' written notice to the City. In the event of termination initiated by Developer, all drawings, reports, studies and site improvements prepared in connection with the terms and conditions of this agreement shall become the property of the City at no cost to the City. C. This agreement may be terminated by the City in the event that the Developer is determined by the City to be in default as provided in Section VIII. This termination shall be effective 30 days after Developer's receipt of a termination notice. The City shall set forth the reasons for the termination. Within such 30 day period, the Developer shall have the right to contest the City's termination. The decision of the City to terminate shall be final. X. Amendments. The City and/or Developer may request, from time-to-time, amendments in the terms and conditions of this agreement.
