City within thirty (30) days from the date of <br />invoice. <br />b. If and when it becomes necessary to obtain an Order <br />of Immediate Possession, Developer will advance the <br />required deposit_to the City for deposit in the <br />State Condemnation Deposits Fund. City will remit <br />any interest received from the State Condemnation <br />Deposits Fund minus an administrative fee of $25.00 <br />per transaction. <br />a. Developer will pay the City an amount equal to the <br />Judgment in condemnation prior to City paying such <br />Judgment. <br />5. Management of Litigation <br />The City Attorney shall control and supervise the action <br />in eminent domain. The City Attorney may, in his <br />discretion, select outside counsel to pursue this <br />action. The City Attorney will consult with Developer <br />regarding the course of the litigation, particularly <br />with respect to settlement offers. <br />23 <br />
