WHEREAS, Developer has prepared the final subdivision <br />map and improvement plan which requires use of a sanitary <br />sewer lift station and Developer wishes to dedicate it to <br />the City for maintenance and operation; and <br />WHEREAS, Developer wishes to record the final map as <br />soon as possible; and <br />WHEREAS, Developer and City have yet to agree on the <br />manner or the amount of payment as required by Condition ~~14 <br />of the tentative map approval, but that both Developer and <br />City feel agreement will be reached. <br />NOW, THEREFORE, the City and Developer agree as follows: <br />1. Agreement to Zegotiate <br />City and Developer shall continue to negotiate upon the <br />manner of providing a maintenance fund for the sanitary <br />sewer lift station, and the amount thereof, designed to <br />provide maintenance for a minimum ten year period prior to <br />the acceptance of the subdivision improvements of Tract <br />4372. <br />2. Discretion of City <br />In the event agreement has not been reached within 120 <br />days of this agreement, the City Engineer in his sole discretion <br />shall determine the amount and manner of Developer's obligation <br />to provide a maintenance fund for the sanitary sewer lift <br />station for the ten year period required by Condition ~~14 of <br />the tentative map approval. <br />3. Successors in Interest <br />This agreement shall run with the land and be binding <br />upon any and all heirs, assigns, and successors in interest <br />-2- <br />
