Me er ' hereafter referred to as "Property Owner" and the~CITY OF PLEASANTON, a municipal corporation, hereafter referred to as "City". R E C I T A L S THIS AGREEMENT IS BASED UFON THE FOLLO~aING FACTS: (1) Property owner is the owner of real property in the City of Pleasanton described in Exhibit "A", attached to this Agreement and made a part of it by this reference; (2) On May 12 , 1981 , the City granted a pursuant to Ordinance No. 973 _ development plan approval/to said property; (3) By the terms of the above approval, property owner is required to install and maintain landscaping in accordance with a plan, to be approved by the Planning Department prior to Build- ing Permit approval; (4) Both parties recognize that the installation and maintenance of landscaping is an integral part of the property owner's plan for development of the property. The purpose of this Agreement is to assure (a) installation in accordance with the landscaping plan previously approved by the City and (Ib) continued maintenance and care of the landscaping. "
