NOW, THEREFORE, in consideration of the faithful performance by <br />the promises, terms, conditions and covenants set forth herein by <br />Subdivider and the approval of the map for recording by the City <br />the parties hereto agree as follows: <br />1. Time of Essence. Time is of the essence in the performance <br />of this agreement. The work and improvements required by this agree- <br />ment to be completed by Subdivider shall be completed within one (1) <br />year from the above-mentioned date of this agreement. <br />2. Work. Subdivider will do or cause to be done and performed <br />the following described work: <br />a. Improvements pursuant to approved plans entitled <br />"Improvement Plans, Parcel Map 3858, Hacienda Business <br />Park, Pleasanton, California (Prudential Portion)" <br />prepared by Bissell and Karn, Inc., Civil Engineers, <br />dated February, 1982. <br />b. Improvements pursuant to plans reviewed and approved by <br />City Engineer and approved by City Council, entitled <br />"Street Improvement Plans, West Las Positas Blvd. <br />from S.P.T. Co, to Santa Rita Road, Pleasanton, California," <br />prepared by Bissell and Karn, Inc., Civil Engineers, <br />dated June, 1982. <br />c. Improvements pursuant to proposed plans to be reviewed <br />and approved by City Engineer and approved by City Council, <br />for widening of Santa Rita Road between West Las Positas <br />Boulevard and Interstate 580 to a minimum of four travel <br />lanes. Improvements to include modification of traffic <br />signal on Santa Rita Road at Pimlico Drive. <br />d. Improvements and purchases pursuant to plans and specif- <br />ications of a traffic master controller system, inter- <br />connect system, and sufficient expansion of City offices <br />to house the traffic computer. Plans and specifications <br />to be reviewed and approved by City Engineer and approved <br />by City Council. <br />e. All landscape and irrigation required for the improvements <br />of Hacienda Business Park, Phase I (Prudential Portion) <br />upon final approval of City Engineer. <br />f. All signal, striping and signing required for the public <br />improvements of Hacienda Business Park, Phase I (Prudential <br />Portion) upon final approval of City Engineer. <br />g. All joint trench and utility work required for the <br />improvements of Hacienda Business Park, Phase I (Prudential <br />Portion) upon final approval of City Engineer. <br />-2- <br />
