suffered, by reason of any of the aforesaid operations referred to in this paragraph, regardless of whether or not City has prepared, supplied or approved of plans or specifications for the project, or regardless of whether or not such insurance policies shall have been determined to be applicable to any of such damages or claims for damages. 12. Insurance. Developer further agrees to fulfill the following: a. Provide a Certificate of Insurance issued to the City of Pleasanton from his insurance carrier providing proof of worker's compensation and policy number. b. Provide a Certificate of Insurance from his insurance carrier showing the amount of public liability and property damage coverage and naming the City of Pleasanton and agents as an additional insured. Insurance coverage shall be in at least the following amounts: PUBLIC LIABILITY General Bodily Injury - General Property Damage - or Combined Single Limit on Damage Liability - AUTOMOBILE LIABILITY $1,000,000 Per Occurrence $ 100,000 Per Occurrence Bodily Injury and Property $1,000,000 Bodily Injury - $500,000 Per Person/$1,000,000 Per Occurrence Property Damage - $100,000 Per Occurrence or Combined Single Limit on Bodily Injury and Property Damage Liability - $1,000,000 13. Attorney's Fees. In the event either party shall institute and prevail in any action or suit for the enforcement of any of its rights under this agreement, the prevailing party shall be entitled to a reasonable attorney's fee as may be fixed by the court on account thereof. 14. Notices. All notices herein required shall be in writing and delivered in person or sent by certified mail, postage prepaid.
