~ ~ <br />(e. g. , Dura Drain Fossil Filter'''"`) needs immediate correction as a result of a public safety or <br />health hazard, as reasonably determined by the City Engineer, and such maintenance is not <br />performed, or cannot be performed, by the Owner immediately, the City may perform or <br />cause to be performed such maintenance. In such event, the City's performance of such <br />maintenance shall be at the Owner's sole expense and the Owner, upon demand by the City, <br />shall pay to the Cityall reasonable expenses incurred by the City in the performance of such <br />maintenance. <br />7. Duration. This agreement shall be a covenant which is to run with the land <br />for the duration of the structures located at 5700 Owens Drive and be binding upon the heirs, <br />successors and assigns of the parties hereto. In lieu of recording this Agreement, if Owens <br />should sell or transfer the Property, it shall expressly inform the purchaser/transferee in <br />writing, with a copy to the City, of this Agreement. Should Owner fail to do so, the <br />obligations of this Agreement will be personal to Owner notwithstanding its transfer of the <br />Property. The Owner may modify or terminate this agreement at any time by written <br />Alameda County.
