Following completion of audit, Railroad <br />shall submit to City a final bill for the actual total cost of <br />the work performed by Railroad, less the progress payments made by <br />City hereunder. City shall pay all of such bills promptly. <br />In the event progress payments made by City exceed the audited <br />total final cost, the difference shall be promptly refunded to City <br />by Railroad. <br />7. Any contractor performing work on the property of Railroad <br />on behalf of City, in connection with work contemplated hereunder, <br />shall execute Railroad's standard form of Contractor's Right of Entry <br />agreement prior to commencing any work on Railroad's premises. <br />8. City shall obtain any governmental authority which may be <br />required in connection with the work contemplated. <br />9. This agreement is subject to the rights of Southern Pacific <br />Pipe Lines, Inc., hereinafter termed "Pipe Line Company," to construct <br />and maintain a petroleum, natural gas and related products pipeline, <br />a portion of which is located beneath the premises as indicated on the <br />attached print. City agrees to reimburse Railroad and/or Pipe Line <br />Company for any expense which either might incur, which expense would <br />not have been incurred except by reason of the use of the premises by <br />City, its agents, employees or invitees. City shall require its con- <br />tractor to notify Pipe Line Company's District Superintendent at <br />Roseville, California, at least one (1) week prior to commencement of <br />work in the vicinity of the said pipeline. Cover over said pipeline <br />shall not be reduced without written permission from Pipe Line Company. <br />10.
