the following CITY streets ("STREETS"): Junipero Drive, Bernal <br />Avenue, Abbie Street, Angela Street, Neal Street, Spring Street, <br />Ray Street, Stanley Boulevard, Busch Road, Mohr Avenue, Santa <br />Rita Road, Stoneridge Drive, W. Las Positas Blvd., Hacienda Drive <br />and Owens Drive, all as more particularly shown on the COMPANY'S <br />Application for an Encroachment Permit dated ,~UIwST `1~, 1996 <br />on file with the CITY. <br />F. The Project, as proposed, does not interfere with <br />CITY'S STREETS, other uses of the CITY'S STREETS, or CITY'S <br />public utilities in the STREETS. <br />NON, THEREFORE, in consideration of the faithful performance <br />of the terms and conditions set forth in this Agreement, the <br />parties agree as follows: <br />1. DEFINITIONS. <br />a. "CITY" refers to the City of Pleasanton, its officers, <br />employees, agents and contractors. <br />b. "CITY'S representative" refers to the City Engineer for <br />the City of Pleasanton. <br />2. MAINTENANCE OF PROJECT IN CITY'S STREETS. CITY shall <br />allow COUNTY and COMPANY to maintain the Project in CITY'S <br />STREETS subject to this Agreement. <br />3. COUNTY'S AND COMPANY'S RESPONSIBILITIES. COUNTY and <br />COMPANY shall be responsible for the following: <br />a. After completion of all work, COUNTY and COMPANY shall <br />exercise reasonable care in inspecting and maintaining <br />the area affected by the encroachment. While the <br />2 <br />
