STREETS are also required to be relocated/removed. If this
occurs, this Agreement shall terminate. If COUNTY fails to
remove the Project pursuant to the CITY's demand, CITY may cause,
at COUNTY's sole expense, the Project to be removed, relocated,
or abandoned. Nothing in this Agreement shall affect the CITY's
existing or future use of CITY's STREETS, including the
installation of any additional utility conduits or any other uses
by the CITY, provided CITY will not permit other
telecommunications conduits or facilities to relocate in place of
the Project. Except under emergency circumstances, CITY shall
make reasonable efforts to notify the COUNTY and COMPANY by a
minimum of thirty (30) calendar days advance notice that the
Project in the STREETS will need to be removed or relocated.
CITY shall make reasonable efforts to minimize disrupting the
Project and shall discuss with COUNTY and COMPANY the
organization of the CITY's work in the CITY's STREETS so that the
Project's operational needs can be reasonably met.
6. NO INT}3RFERENCE NITH CITY•S OPERATION. The Project
shall be constructed, installed, and, at all times, maintained,
repaired, renewed and operated in such manner as to cause no
interference whatsoever with the constant, continuous and
uninterrupted use of the CITY's STREETS, and COUNTY and COMPANY
shall do nothing to impair the safety thereof. COUNTY and
COMPANY shall not interfere with any existing CITY utility and
CITY shall consult with COUNTY and COMPANY to avoid any conflicts
with CITY's installing or approving new utilities in the STREETS.
5
