City shall c"ause the sale of bonds for the <br />Valley Avenue Extension Improvement District, the proceeds <br />of which shall be used in part to reimburse Valley for all <br />costs and expenses incurred or paid by Valley hereunder, if <br />such costs and expenses are included as a part of the costs <br />and expenses financed by the district and such costs and <br />expenses are reimburseable to Valley. Reimbursement by the <br />City shall be made within thirty (30) days after the sale of <br />the bonds of the district. In the event the City cannot <br />reimburse such costs through repayment following the sale of <br />the bonds of the district, City shall (to the extent legally <br />possible) grant Valley a credit against any assessments <br />levied against Valley's property in the amount of the funds <br />advanced by Valley. <br />4. Procedure if No Assessment District. In the <br />event no Valley Avenue Extension Improvement District is <br />formed, all costs, expenses and/or obligations incurred or <br />paid by Valley as a result of this agreement shall be the <br />sole responsibility of Valley. In the event the district <br />formed does not include as reimburseable costs all of the <br />costs and expenses incurred or paid pursuant to this <br />agreement, those costs and expenses not reimburseable shall <br />be the sole responsibility of Valley. In the event costs <br />and expenses in excess of Thirty Thousand and no/100ths <br />Dollars ($30,000.00) are incurred by the City, all costs <br />and expenses incurred or paid by the City in excess of <br />-4- <br />
