necessary by the City Manager. Developer agrees to participate
in the funding of such apparatus, manpower and other facilities
in whichever manner best achieves the maintenance of existing
levels of fire service through timely additions of fire safety
equipment facilities and personnel, as determined by City. In
determining the level of participation of such funding agreed to
herein, City shall take into consideration the project's contrib-
ution towards fire services in its ordinary contribution towards
funding city services generally (via taxes, etc.).
VI. DEVELOPER'S RIGHTS
With reference to each of the agreements contained herein to
place subject site into one or more assessment districts, benefit
districts, or other district or funding mechanism requiring
approval of all or a majority of properties so included, the
developer agrees to either (1) not protest the establishment of
the district or (2) to affirmatively vote for the creation of the
district or other mechanism, depending on the manner of creation
of the funding mechanism. However, Developer retains the right
to protest that the allocation of costs among various properties
is inequitable under any of the above-mentioned funding mechanisms.
Moreover, the City agrees to act reasonably whenever it (or
its City Engineer, City Attorney or City PZanager) makes any
determination hereunder, including, without limitatin, the deter-
mination of the need for or form of an assessment district or
funding mechanism or the need for any facility, improvement or
study.
In the event the assessment mechanism appears to impose
economically infeasible levels of cost upon the project site, the
City agrees to explore alternate financing methods.
-5-
