''~hidc"~c ~ ~ ~ <br />', `, 5.29.81 <br />l ~ C169-020 <br />3.4 Maintenance. <br /> <br />Grantor and Grantee acknow- <br />ledge that after the Storm Drain. is dedicated to the City of <br />Pleasanton, the Storm Drain will be maintained by the City <br />of Pleasanton. During the interval between completion of <br />construction of the Storm Drain and completion of its dedi- <br />cation to the City of Pleasanton, Grantee shall maintain the <br />Storm Drain in good condition and repair at its own expense. <br />ARTICLE IV <br />LIABILITY FOR PERSONAL INJURY <br />AND PROPERTY DAMAGE <br />Any uninsured liability of Grantor or Grantee for <br />personal injury to any workman employed to perform construc- <br />tion or make repairs under this Agreement, or to third per- <br />sons, as well as any liability of Grantor or Grantee for <br />damage to the property of any such workman or third person, <br />as a result of or arising out of the construction of the <br />Storm Drain or the repairs to the Easement Area, shall be <br />borne by the Grantee. Grantor and Grantee shall both be <br />named as insureds on all liability insurance policies car- <br />ried by either or both of them which include the Easement <br />Area. <br />ARTICLE V <br />INDEMNIFICATION <br />Grantee agrees to defend Grantor with respect to <br />any and all demands, claims, causes of action, or assertions <br />-5- <br />
