<br /> (c) Deductibles and Self-insured Retentions- Any deductibles or selfinsuued retentions shall be declared to the
<br /> Lessor. If Lessee does not provide evidence of compliance-with regulatory requirements for self-insurance upon
<br /> request,Lessor may require Lessee to post a bond guaranteeing payment of losses and reasonably related expenses for
<br /> any claims arising out of performance of this contract. Lessor and Lessee waive any right of recovery against the
<br /> other for loss'due to hazards covered by the above insurance, and shall require their insurance policies to reflect the
<br /> foregoing waiver of claims.- •
<br /> (d) Other insurance Provisions..The general liability policy shall contain, or be endorsed to contain, the following
<br /> provisions:
<br /> 1. Lessor,its officers,officials,employees, agents and volunteers are to be covered as insureds as respects:
<br /> liability arising out of Premises owned,occupied, or used by the Lessee. The coverage shall contain no
<br /> special limitations of the scope of protection afforded to Lessor,its officers,officials,employees,agents, or
<br /> volunteers.
<br /> 2. Lessees insurance coverage shall be primary insurance as respects Lessor,its officers,officials,
<br /> employees, and volunteers.Any insurance or self-insurance maintained by Lessor,its officers,officials;
<br /> employees, agents,or volunteers shall be in excess of Lessee's insurance and shall not contribute'with
<br /> it.
<br /> 3. My failure to comply with reporting or other provisions ed the policies including breaches of warranties
<br /> shall not affect coverage provided to Lessor,its officers,officials,employees,agents,or volunteers,unless
<br /> such breach is caused by the negligence or misconduct of Lessor,its officers,officials,employees, agents,
<br /> or volunteers.
<br /> 4. Coverage shall state that Lessee's insurance shall apply separately to each insied against whom a claim
<br /> is made.or snit brought, except with respect to the limits of the insurer's liability.
<br /> 5 Insurer shall endeavor to provide thirty(30)days written notice by certified mail,return receipt requested, to
<br /> Additional Insured prior to suspension or cancellation of coverage for any reason.
<br /> (e) Ss.of ins„rrrs. Insurance is to be placed with insurers with a current A.M. Best's rating of no less
<br /> than A n.
<br /> (f) Verification_of Coverage. Lessee shall furnish the Lessor with Certificates of Insurance, and copies of
<br /> endorsements required by this contract. The endorsements are to be signed by a person authorized by the insurer to
<br /> bind coverage on its behalf. All Certificates are to be received by the,Lessor before work begins.
<br /> (g). At its discretion,Lesseemay self insure exposure to loss by its own policy.
