<br />the Division of the State Architect as required by law pertaining to public school facilities. In <br />addition, the School District shall obtain any additional approvals for the construction of such <br />Gymnasium Facility as required by law. The Gymnasium Facility shall be constructed in strict <br />conformance with applicable laws, regulations and ordinances. The School District shall obtain <br />all permits and pay all fees and licenses necessary for the construction of the Gymnasium Facility <br />and to comply with the rules and regulations of the Division of the State Architect. <br />3. Plans for the Gymnasium Facility. The School District shall make available to <br />the City a copy of all plans for the Gymnasium Facility, a copy of the reports of all test borings <br />and subsurface explorations, and an accurate survey of the Hart Middle School site, giving the <br />grades and lines and streets, pavements and adjoining properties, the rights, restrictions, <br />easements, boundaries and contours of the site, and information as to the sewer, water, gas and <br />electrical service. <br />4. City Council Approval of the Gymnasium Facility. All plans and <br />specification[s] for the construction and installation of said Gymnasium Facility shall be made <br />available to the City Council prior to City acceptance of the Gymnasium Facility. City shall have <br />the right to make changes to plans and specifications for the City Facility prior to the time that the <br />Gymnasium Facility is put out to public bid pursuant to laws and regulations regarding the <br />construction of school facilities, subject to written acceptance of said changes by School District. <br />5. Inspection During Construction. The City shall, at all times during construction, <br />have the right to inspect the Gymnasium Facility and the work in progress and the right to require <br />construction defects to be corrected. <br />6. Final Inspection. Prior to the acceptance of the Gymnasium Facility as evidenced <br />by City approval of this Agreement, the City and School District shall jointly make a preliminary <br />and final inspection of the work prior to acceptance of the completed work. <br />-3- <br />
