and qualified recreational personnel to fulfill these responsibilities. All personnel employed in <br />connection with City's use of the Gymnasium Facility for recreational programs shall be deemed <br />City employees or its agents. The hiring, supervision and discipline of all such personnel shall be <br />the responsibility of City. City agrees to procure and maintain in full force and effect, workers <br />compensation insurance coverage, or be lawfully self insured, for such recreational personnel for <br />any death, injury or illness arising in connection with the City's performance of this Agreement. <br />(c) At all times when Gymnasium Facility is used by School District, the Gymnasium <br />Facility shall be under the supervision and control of School District, its agents and employees <br />and administered and operated in accordance with all rules and regulations established by both <br />School District and the City. If conflict occurs between the two agencies' rules, the stricter rule or <br />regulation shall apply. School District agrees to assume full responsibility for the scheduling, <br />supervision and control of educational or recreational activities conducted by School District. <br />School District further agrees to provide adequate and qualified recreational or educational <br />personnel to fulfill these responsibilities. All personnel employed in connection with the School <br />District's use of the Gymnasium Facility shall be deemed School District employees or its agents. <br />The hiring, supervision and discipline of all such personnel shall be the responsibility of School <br />District. Such equipment shall remain the property <br />of the party furnishing it.
