EXHIBIT A
CONSTRUCTION AND SEP.VICE SCHEDULE
Beginning no later than January 1, 1986 the Grantee agrees to offer, as a
minimun, the average number of satellite delivered cable services carried on
cahle systems in the San Francisco Bay Area. At any time during the franchise
term that the Grantee fails to offer, as a minimum, the average r~rumber of
satellite delivered cable services carried on cable systems in the San
Francisco Bay Area, the Grantee shall cormence a cable system upgrade of
channel capacity to a minimum of forty (40) video channels. The Grantee shall
complete said upgrade within a period of fifty-four (54) months.
All Cit}• residents, except as indicated in Exhibit G, shall be offered
upgraded service at standard installation charges and montfrly rates.
No earlier than three years after the completion of the system upgrade to
forty (40) channels, the Grantor may issue findings that the forty (40)
channel capacity of the system is inadequate in light of the available
services generally offered to comparable communities, and direct the Grantee
to expand the system capacity to no more than fifty-four (54) channels within
a three (3) year period. The burden of proof, shall be upon the Grantee to
demonstrate that such expansion tirould not be feasible, and, in the absence of
such proof, the Grantor may find that a material breach of the franchise trill
occur if the Grantee refuses to expand system capacity.
For the purpose of computing the average number of satellite delivered cable
services carried on cable systems in the San Francisco Bay Area, the following
list of cable systems shall be used:
f1S0/System Number of Satellite Signals
Gill/San Jose 19
Jones/Castro Valley 15
Hearst/Santa Clara 11
Hearst/Los Gatos 11
Hearst/Nevark 16
Hearst/~iilpitas 9
TCI/Berkeley 5
TCI/Richmond 9
TCI/Fremont 10
TCI/San Carlos 9
TCI/San tiateo 10
TCI/Hill brae 5
TCI/Daly City 11
TCI/Sunnyvale 9
TCI/Pacifica 4
United/Cupertino 18
United/Alameda 22
United/Foster City 11
United/Hayrrard 11
United/San Leandro 11
Viacom/Pittsburg 15
Viacom/Napa 11
Viacom/Petaluma 9
Viacom/Mountain View 22
/g
