Commissioner Arkin noted that he supported this item and that he had visited the site, which was a
completely different situation than the last chicken application. He noted that the coop was well
designed and insulated the sound adequately. He had not received any complaints.
THE PUBLIC HEARING WAS CLOSED.
In response to Commissioner Blank's inquiry regarding what the condition requiring the
chickens to be kept in an enclosed space meant, Ms. Decker replied that the chickens may be
allowed to roam the grounds of the residence or enclosed area of the back yard, but they may not
be allowed outside the fence.
Commissioner Fox noted that the yard was well screened by foliage.
Commissioner Blank noted that he would like to have consistency in the conditions regarding
chickens.
Chairperson Maas noted that she did not mind making specific conditions for different
applications if needed. She asked staff if the Commission would have an opportunity to review
the standards should the Municipal Code be amended with respect to the keeping of chicken and
fowl.
Ms. Decker noted that this process was still relatively new and added that a Code amendment
would be brought forward in the future with standards. The Commission would have an
opportunity to discuss those standards in greater detail at that time.
Commissioner Roberts noted that their chickens were wonderful pets.
Commissioner Arkin moved to make the required use permit findings stated in the staff
report and to approve PAUP-2, subject to the conditions of approval listed in Exhibit B, as
recommended by staff.
Commissioner Fox seconded the motion.
Commissioner Blank proposed the following amendments to the motion:
1. that the use permit be restricted to the existing four chickens, and a new permit be
required for additional chickens; and
2. that staff establish a mechanism for neighbors to make complaints.
3. that Condition of Approval No. 4 be clarified to state that "enclosed space" meant
fenced backyard.
Commissioners Arkin and Fox accepted the proposed amendments.
Commissioner Pearce noted that while the City Council was anticipating making this a permitted
use, its adoption was not a certainty. She was concerned that by allowing people to have only
their existing chickens, people would be encouraged to get their chickens and then come in for a
permit after the fact.
Chairperson Maas believed that this was coincidental with the Beckers and this family having
tour chickens; the next applicant may have two existing chickens.
EXCERPTS: PLANNING COMMISSION MEETING MINUTES, October 19, 2005 Page 2 of 3
