very seriously. And my engineers are reminding me on a regular basis that if I had the
ability to do more grading and more stories, I could get more value out of that property.
And so, I am running under the assumption that I do not have that option, that this
Specific Plan really is a Plan that we are going to follow.
But, in allowing these sorts of changes, we are setting the precedent of changing that.
Then I think I would have to go back and revisit that, and I would be back here with plans
that would take advantage of that as well, because I think I could do some interesting
things there as well.
So, I guess what I am really saying is that the decision to accept the plan as presented
really changes the character as defined by the Specific Plan and takes this part of the
Vineyard Comdor down a path that was not contemplated or intended in that planning.
And so, I would ask that you get this proposal far more in line with what the Plan had in
mind. Thank you.
Chairperson Maas: Thank you. Mary Roberts? And that's the last speaker card that I have.
Ms. Mary Roberts: [distributing materials to Commission] Thank you. Okay, I may refer to
this, and that's why I wanted you to have these copies -it's very difficult when you get
up on our property, or their property, to know what we are talking about here. I come
before you this evening without legal counsel, without a consultant, but I do have the
Vineyard Avenue Corridor Specific Plan. Furthermore, I have several staff reports that
support the Vineyard Avenue Corridor Specific Plan, except for the last staff report.
You'll notice that in our last meeting on August 24th, this was continued to September.
And in the continuation, the. staff report changed considerably. So, the old staff report is
quite a bit different, and I'm going to go back to it, and I can understand why the
Sariches, their consultant, and -their lawyer were concerned about the staff report -and all
these staff reports -because the .staff report of June. 8, 2005 begins with a summary, and
the summary starts: "The proposed Sarich residence is not supported by staff in the form
that it is being presented to the Planning Commission."
There are several other references: On page 2 of that report - "The applicants have
presented much the same design since the preliminary review process was begun in 2002.
This proposal would require a Specific Plan Amendment that would not be site-specific,
but rather be the direction from this point forward for all proposals." And this is what
Greg Reznick was talking about.
Over here, I have a vineyard, and three hillside residential lots are generally depicted
here. Now, theirs is quite specific. Here's the house, that is, and the other place that was
given for the garage for the additional house. Up the hill, there is a much better view,
and the very top of our property is a great place, a fantastic place. You can see
Livermore and Pleasanton and all the hills, and I could not build a house up there, but
somebody who has enough money could do so. So, this is a little bit what Greg was
talking about -if you say we can all do whatever we want to do, I think we're throwing
the whole thing out.
9
