Insurance: The Authority shall insure itself and the <br />Parties against, or otherwise make provision for, loss, liability <br />and claims arising out of or in any way connected with this <br />Agreement. <br /> <br />XVIII.Discharger's Obligations. <br /> <br /> For any Project or Projects with respect to which any of the <br />Parties discharge wastewater effluent to Facilities owned, <br />operated or maintained by the Authority, each such Discharger <br />shall cause its wastewater effluent to meet applicable federal <br />and/or state discharge requirements and cause said effluent to be <br />monitored to determine whether or not said federal and/or state <br />discharge requirements are being met for such discharge and the <br />combined effluent transported to or through any Facility of the <br />Authority. Such Dischargers shall cause records of their <br />monitored effluent to be available for inspection by employees or <br />representatives of the Authority during normal working hours. If <br />the combined effluent of all such Dischargers at the point of <br />ultimate discharge into a receiving water fails to meet discharge <br />requirements, the Discharger or Dischargers responsible for such <br />violation shall be solely responsible for any fines levied or <br />criminal sanctions imposed. Such Discharger or Dischargers <br />responsible for such violations shall hold harmless the Authority <br />and each and every other Party not in violation of applicable <br />discharge requirements from any and all liability and/or damages <br /> <br /> 23 <br /> <br /> <br />
