REIMBURSEMENT AGREEMENT FOR <br /> FINAL DESIGN CONSTRUCTION <br /> I -580 FALLON ROAD /EL CHARRO ROAD <br /> INTERCHANGE MODIFICATIONS <br /> THIS AGREEMENT is made this day of June, 2003 by and between <br /> CITY OF PLEASANTON, a municipal corporation (hereinafter referred to as <br /> "Pleasanton and CITY OF DUBLIN, a municipal corporation (hereinafter referred to as <br /> "Dublin <br /> RECITALS <br /> WHEREAS, Pleasanton and Dublin have mutual interest in performing physical <br /> modifications to the I -580 Freeway, Fallon Road /El Charro Road interchange; and <br /> WHEREAS, said physical modifications will impact the I -580 Freeway which is <br /> under the control and jurisdiction of the State of California, Department of Transportation <br /> (hereafter "Caltrans and <br /> WHEREAS, Dublin has recently prepared a draft Project Report/Environmental <br /> Document (hereafter "PR/ED for proposed improvements to the I -580 Freeway, Fallon <br /> Road/E1 Charro Road interchange as required mitigation associated with the approved <br /> Eastern Dublin Specific Plan/General Plan Amendment. <br /> WHEREAS, Dublin and Pleasanton recently agreed to have the draft PR/ED <br /> amended to include additional improvements at the 1 -580 Freeway, Fallon Road /El <br /> Charro Road interchange as required mitigation associated with proposed developments <br /> in Pleasanton. It is understood Caltrans is set to approve the required PR/ED for the <br /> project; <br /> WHEREAS, Caltrans requires the final plans, specifications, and estimates <br /> (hereafter PS &E) to be performed for any proposed physical modifications to its <br /> facilities; <br /> WHEREAS, Dublin has solicited and obtained the following additional project <br /> management, design services and construction cost estimates information: <br /> 1. Scope of Work and Fee Proposal from CCS, Inc. dated March 6, 2003 for the <br /> required additional final design PS &E work associated with the proposed <br /> developments in Pleasanton, attached hereto as Exhibit A and made a part of <br /> this agreement. <br /> 2. Scope of Work and Fee Proposal from Cordoba Consulting Inc. dated March <br /> 25, 2003 for the required additional project management services associated <br /> with the proposed developments in Pleasanton, attached hereto as Exhibit B <br /> and made a part of this agreement. <br />
