DocuSign Envelope ID: 11 CECBDC-4F09-4631-B96C-4583C5CB1334 RIGHT OF ENTRY FOR CONSTRUCTION AND LICENSE FOR LANDSCAPE MAINTENANCE 164 Main Street This Right of Entry for Construction and License for Landscape Maintenance (the "Agreement") is entered into this Feb . 3 , 2021 , between the City of Pleasanton ("City") and the Russell J. and Eloisa S. Leonardini Trust (collectively the "Owner"), the owners of real property described in this Agreement. RECITALS WHEREAS, City is improving its public parking lot located at 50 Abbie Street (the "City Parking Lot"), which is adjacent to Owner's real property commonly known as 164 Main Street ("Property", APN 094 015701200); and WHEREAS, City's improvements to City Parking Lot include increasing parking spaces and installing landscaping. Some of the new landscaping is proposed to be located on a portion of the Property as shown in Exhibit A (the "Landscape Area"); and WHEREAS, City will also make improvements to Owner's private parking lot on the Property as described in this Agreement; and WHEREAS, Owner is willing to allow City to install and maintain landscaping in the Landscape Area, as well as make improvements to Owner's private parking lot on the Property, subject to the terms of this Agreement. NOW, THEREFORE, in consideration of the mutual promises contained in this Agreement, the parties agree as follows: 1. Improvements to Owners' Private Parking Lot. Without cost to Owner, the City, its employees and contractors will make the following improvements to Owner's property as follows: a. Install landscaping and irrigation b. Resurface parking lot on both side of building c. Restripe parking lot; d. Install six (6) wheel stops on existing parking spaces e. Remove existing concrete pad and Install concrete path by rear building exit; f. Install 42 L.F. concrete curb; g. Install 60 L.F. of concrete curb and gutter; and h. Cap existing irrigation feed after the backflow device. 1
