A94-56-PLE <br /> <br />LICENSE ~OREE~ENT <br /> <br /> THIS LICENSE AGREEMENT is made and entered into this <br /> 19th day of October , 1994~, by and <br />between the ¢IT¥ OF FAEASANTON (hereinafter referred to as <br />"City") and ALAMEDA COUNTY FLOOD CONTROL ANDWATERCONSERVATION <br />DISTRICT, ZONE 7 (hereinafter referred to as "Zone 7"). <br /> <br />RECITALS <br /> <br /> WHEREAS, City has various street rights of way throughout <br />the City which are used to house public utility lines and <br />facilities; and <br /> <br /> WHEREAS, Zone 7 has constructed a 36-inch water transmission <br />line ("transmission line") from the easterly end of Vineyard <br />Avenue near Clara Lane to Santa Rita Road; and <br /> <br /> WHEREAS, Zone 7 has requested that <br />City's various street rights of way for <br />maintainingthis transmission line; and <br /> <br />it be allowed to use the <br />installing and <br /> <br /> WHEREAS, this line will benefit City's water uses and will <br />not interfere with any existing City facilities, <br /> <br /> NOW, THEREFORE, in consideration of the mutual promises and <br />covenants herein contained, the parties agree as follows: <br /> <br /> 1. LICENSE GRANTED. City grants to Zone 7 the right to <br />construct and thereafter, during the term hereof, to maintain and <br />operate the transmission line in the locations shown and in <br />conformity with the Plans and Specifications for the Vineyard <br />Water Transmission Pipeline; a map showing the general location <br />of the transmission line is attached. <br /> <br /> 2. LICENSE FEE. Zone 7 shall pay City the sum of one <br />dollar as a license fee. <br /> <br /> 3. EFFECTIVE DATE. This agreement shall take effect as of <br />the date first herein written and shall continue in full force <br />and effect until terminated as herein provided. <br /> <br /> 4. WORK PERFORMED BY ZONE 7 OR ITS CONTRACTOR. If Zone 7 <br />or its contractor is to do any subsequent work on the <br />transmission line (including relocation or substantial <br />maintenance and repair work), then Zone 7 shall execute or <br />require its contractor to execute City's encroachment permit <br />except in exigent or emergency circumstances. <br /> <br /> 5. SUBMITTAL OF PLANS. Except in exigent or emergency <br />circumstances, prior to the commencement of any work in <br /> <br /> <br />
