AGREEMENT FOR INSTALLATIO~ AND MAINTENANCE <br /> <br /> OF LANDSCAPING' <br /> <br /> THIS AGREEMENT is made this /~ day of May , <br /> <br />19 84 , between DUDLEY ENTERPRISES, INC. <br /> <br />hereafter referred to as "Property Owner" and the CITY OF PLEASANTON, <br />a municipal corporation, hereafter referred to as "City" <br /> <br />RECITALS <br /> <br />THIS AGREEMENT IS BASED UPON THE FOLLOWING FACTS: <br /> <br />(1) Property owner is the owner of meal proper.ty in the City of <br /> <br />Pleasanton described in Exhibit "A", attached to this Agreement and <br />made a part of it by this reference; <br /> <br /> (2) On September 14 , 1~3 , the City granted a Board <br /> <br />of Adjustment variance <br /> <br />approval to said property; <br /> <br /> (3) By the terms of the Board of Adjustment approval, property <br /> <br />owner is required to install and maintain landscaping in accordance <br /> <br />with a plan, to be approved by the Planning Department prior to Build- <br />ing Permit approval; <br /> <br /> (4) .Both parties recognize that the installation and maintenance <br />of landscaping is an integral part of the property owner's plan for <br /> <br />development of the property. <br /> <br />NOW, THEREFORE, IT IS AGREED BETWEEN THE PARTIES, as follows: <br />1. Purpose.
