ACTA # A04-0020 AGREEMENT between the ALAMEDA COUNTY TRANSPORTA nON AUTHORITY and the CITY OF PLEASANTON This AGREEMENT is made and entered into on April 22, 2004, by and between the ALAMEDA COUNTY TRANSPORTATION AUTHORITY, a local public agency (hereinafter referred to as "AUTHORITY") and the City of Pleasanton, a general law city, 123 Main Street, Pleasanton, California (hereinafter referred to as "CITY"). WITNESSETH WHEREAS, the voters of Alameda County, pursuant to the provisions of the Bay Area County Traffic and Transportation Funding Act, Public Utilities Code Section 131100, et. seq., approved Measure B at the General Election held on November 4, 1986, thereby authorizing a sales tax increase to finance a major transportation improvement program within Alameda County ("1986 Pro6'fam"); and WHEREAS, the AUTHORITY was created to administer the 1986 Program; and WHEREAS, The AUTHORITY, as a part of its Measure B Program, designed and constructed the 1-580/1-680 Direct Connector Project (hereinafter referred to as "PROJECT') in the cities of Dublin and Pleasanton, Alameda County (hereinafter referred to as "COUNTY"); and WHEREAS, the construction traffic generated by PROJECT had significant impacts on the pavement of Johnson Drive in the City of Pleasanton; WHEREAS, the impacts can be mitigated by the slurry sealing of Johnson Drive; and WHEREAS, CITY has followed the public bidding requirements under the Public Contract Code to contract with a third party to undertake the slurry sealing of Johnson Drive at a cost of $27,937.30; NOW, THEREFORE, it is mutually agreed by and between the parties as follows: AUTHORITY agrees to reimburse CITY its direct cost for performing the slurry sealing work with no markup by sending a check for $27,937.30 payable to City of Pleasanton, City of Pleasanton, P.O. Box 520, Pleasanton, CA 94566-0802 upon the execution of this Agreement by both parties.
