PLEASANTON UNIFIED SCHOOL DISTRICT - MS GYMS - 2ND AMENDMENT (#2025481)

SECOND AMENDMENT TO AGREEMENT This Second Amendment to Agreement ("Second Amendment") is entered into this 1st day of July 2026 by the City of Pleasanton ("City") and Pleasanton Unified School District ("PUSD") Whereas, on July 1, 2024, the City and PUSD entered into an agreement for joint use of the Middle School Gymnasiums ("Agreement"); and on July 1, 2025, the City and PUSD entered into a First Amendment to the Agreement: and Whereas the terms and scope of work need to be amended, and Whereas, the parties desire to amend the Agreement; Now, therefore, in exchange for valuable consideration, the receipt of which is hereby acknowledged, the parties agree as follows: 1.Recital F of the Agreement is amended to read: The City and District wish to clarify the use of the Middle School Gymnasiums for Fiscal Year 2026/27. 2.Section 2a of the Agreement, "Term" is amended to read: The term of this Agreement is from July 1, 2026, to June 30, 2027. 3.Section 3 of the Agreement, "Costs," is amended to read: ii.$40.00 per hour (Monday-Friday); $60.00 per hour (Saturday); and $80.00 per hour (Sunday) for custodial obligations related to maintaining the Middle School Gymnasiums and surrounding areas. iii.One-half of the costs of regular maintenance, repair, and upkeep of the Middle School Gymnasiums. Gymnasiums will be utilized by Amador and Foothill High School for a period of time in the 2026/27 school year. The City's maintenance costs will be prorated for only the period the gym is used by the City. c.Payments made by City to District under this Agreement shall not exceed $75,000 annually. 4.All other terms and conditions of the Agreement shall remain in full force and effect.
