GROWTH MANAGEMENT AGREEMENT <br /> THIS GROWTH MANAGEMENT AGREEMENT is made and entered into on the <br /> /9'A day of 5 g4w , 2016, between the property owner, Lovely Lands <br /> LLC, ("Owner").and the CITY OF PLEASANTON, a municipal corporation ("City"). <br /> RECITALS: <br /> A Owner owns a legal or equitable interest in real property commonly <br /> known as 5967 Kolb Ranch (the "Property")in the City of Pleasanton. <br /> B. The City has granted to Owner Design Review approval (P15-0741)to <br /> construct one single family home (the"Project"). <br /> C. The single family home is being developed consistent with the Pleasanton <br /> Municipal Code and P15-0741. <br /> D. City may enter into growth management agreements with project owners <br /> under the City's Growth Management Ordinance. <br /> E. City and Owner wish to enter into a growth management agreement in <br /> order to achieve the benefits of the Project to City and its residents and in accordance <br /> with the purposes of the City's Growth Management Ordinance. <br /> NOW,THEREFORE, in consideration of the mutual promises expressed herein, <br /> City and Owner hereby agree as follows: <br /> 1. GROWTH MANAGEMENT APPROVAL <br /> A City hereby grants growth management approval to the Project for one <br /> (1) single family home in 2016. The Owner may be issued a building permit for the one <br /> (1)single family home provided that a building permit shall not be issued prior to 2016. <br /> II. PROJECT CONDITION <br /> Nothing herein shall reduce any obligation of Owner required as a condition of <br /> any other approvals granted by the City. <br />
