RESOLUTION NO. 2025-059
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON
AUTHORIZING THE CITY MANAGER TO ENTER INTO AN AGREEMENT WITH THE
COUNTY OF ALAMEDA TO ALLOW THE EXCHANGE OF PROPERTY TAX
REVENUE ASSOCIATED WITH THE ANNEXATION OF THE MERRITT PROPERTY
INTO THE CITY OF PLEASANTON (FILED UNDER CASE NO. P22-1089)
WHEREAS, on July 16, 2024, the City Council approved an annexation request of the
Merritt Property into the City of Pleasanton, affirming that the annexation implements the City's
General Plan land use policies and provides for orderly growth at the City's boundaries
(hereinafter the `Project"); and
WHEREAS, under California Revenue and Taxation Code Section 99, annexations
require an agreement between the affected city and county for the exchange of property tax
revenues; and
WHEREAS, the Alameda County Local Agency Formation Commission (LAFCO)
requires adoption of such an agreement as a condition of approval for annexation of the Merritt
Property; and
WHEREAS, Staff and representatives of the County of Alameda have negotiated the
terms of a Property Tax Transfer Agreement that allocates to the City of Pleasanton an
appropriate share of the property tax revenues generated by the Merritt Property, reflecting the
City's responsibility for providing municipal services to the annexed parcels; and
WHEREAS, the City Council finds that approval of the Property Tax Transfer Agreement
is in the public interest and necessary to advance the annexation process.
WHEREAS, on September 9, 2025, the Alameda County Board of Supervisors authorized
the proposed Property Tax Transfer Agreement; and
WHEREAS, on October 21, 2025, the City Council held a duly noticed public hearing to
consider the Property Tax Transfer Agreement, all public comments and testimony, and findings.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES
RESOLVE, DECLARE, DETERMINE, AND ORDER THE FOLLOWING:
SECTION 1. Prior to taking action on the Project, and at a properly noticed public
meeting, the City Council reviewed written and oral staff reports, conducted a public hearing on
the Project and took testimony, and received into the record all pertinent documents related to
the Project (collectively, the "Record Evidence"). The City Council's determination is based on
the Record Evidence, which is incorporated into this Resolution by reference.
SECTION 2. This action is consistent with the adopted General Plan as it would facilitate
the annexation and development of the Merritt property, which actions were approved by the City
Council based on the basis of the project's alignment with the applicable land use designations
and supports the General Plan's Programs, Policies, and Goals, including those related to
implementation of the City's Housing Element, and with General Plan policies with respect to
annexation, insofar as the project would be adequately served by infrastructure and services,
