HERITAGE TREE PROTECTION AGREEMENT <br /> WITHIN TRACT 6033 <br /> (GOLDEN EAGLE FARMS) <br /> THIS AGREEMENT is made this �_ day of <br /> 1995, between (rRt;G- Jrrr/t4" , ( "Homeowner" ) , the <br /> GOLDEN EAGLE HOMEOWNERS ASSOCIATION ("Association" ) and the CITY <br /> OF PLEASANTON ("City" ) . <br /> R E C I T A L S <br /> A. Homeowner is a property owner within Tract 6033 , a <br /> single family subdivision within the City of Pleasanton, commonly <br /> known as Golden Eagle Farms . <br /> B. Homeowner has applied to the City for design review <br /> approval for a single family residence at 8053 GOLDEN EAGLE WAY <br /> C. There are 2 heritage trees on this property. <br /> D. One of the conditions of the City' s approving design <br /> review for this residence is that the Homeowner obtain a written <br /> statement from the Association to ensure that the 2 heritage <br /> trees on the property will be protected, both during development <br /> of the lot and thereafter. <br /> NOW, THEREFORE, in consideration of the mutual promises <br /> expressed herein, the parties agree as follows: <br /> 1 . City grants design review approval for the property at <br /> 8053 GOLDEN EAGLE WAY Pleasanton, California, Lot 45 within <br /> Tract 6033 . <br /> 2 . Homeowner shall protect and maintain the 2 heritage <br /> trees on the property, both during development of the property <br /> and thereafter. <br /> 1 <br />
