Ask AGREEMENT FOR RIGHTS S TEMPORARY CONSTRUCTION LICENSE 1. Pursuant to this Agreement for Rights of Entry and Temporary Construction Licenses ("Agreement"), dated as of November 2002, the Alex V. Spotorno Family Limited Partnership ("OWNER") by the undersigned, its managing general partner, hereby grants to the City of Pleasanton, a municipal corporation ("CITY"), a temporary construction license ("TC License") over Area I and a TC License over Area 2 as depicted on the License Maps attached hereto as Exhibits A and B, respectively and incorporated herein by this reference. 2. The TC License over Area 1 shall be for the purpose of road grading, erosion control and the construction of curbs, gutters and pavement section in order to construct the temporary golf course access road and emergency vehicle access referred to as "Westerly Road." The "Westerly Road Improvement Plan" is on file with the CITY Engineer and incorporated herein by this reference. Construction of Westerly Road by the CITY and its contractor shall be consistent with the Improvement Plan. 3. The drainage ditch depicted on Exhibit A at or near Area 1 provides drainage for the OWNER's properties. Unless and until the CITY replaces it with other drainage improvements through its construction of Westerly Road, the CITY and its contractor shall keep that ditch open or otherwise allow for effective drainage away from the OWNER's "Flat Area Property" during construction.
