FIRST AMENDMENT TO ENCROACHMENT AGREEMENT FOR MONITORING WELLS Area of 555 Main Street, Pleasanton CA THIS FIRST AMENDMENT TO ENCROACHMENT AGREEMENT FOR MONITORING WELLS ("Amendment") is entered into 3 J1 S , 20231 by and between the City of Pleasanton ("City"), Schuering Zimmerman & Doyle, LLP ("SZD"), and EKI Environment & Water, Inc., a California corporation ("Consultant"). RECITALS WHEREAS, City, SZD and Consultant entered into an Encroachment Agreement for Monitoring Wells on November 22, 2021 (the "Agreement"); and WHEREAS, SZD now needs to install five (5) additional monitoring wells and has hired Consultant to install, inspect, maintain and obtain samples from such monitoring wells; WHEREAS, on 3 / 3 v 12 C Z _) , the City approved Encroachment Permit # E23 0115 (the "Second Encroachment Permit") to allow Consultant to install and maintain these five (5) additional monitoring wells approximately two 2-inch casings inside a 10 5/8" OD borehole with 12-inch flush mounted well box to be installed and maintained flush with the sidewalk or pavement, as applicable, on City streets, sidewalks, Rights of Way and PSE, at the locations shown on Exhibit A for the purpose of soil vapor sampling (the "Expanded Project") in order to allow Consultant to monitor conditions related to the San Francisco Bay Regional Water Quality Control Board case referenced in the Agreement. NOW, THEREFORE, in consideration of the faithful performance of the terms and conditions contained in this Amendment, the City, SZD and Consultant agree as follows: 1. City shall allow Consultant to install, inspect and maintain the Expanded Project in the Right of Way and PSE as shown on the attached Exhibit A. 2. Section 5., Subsection (a)(1) is amended to require that Consultant post a performance bond in the amount of $36,675.50 for both the Project and the Expanded Project. The Consultant can provide a second bond for just the Expanded Project and maintain the existing bond for the Project; or the Consultant may replace the existing bond for the Project with a single bond for both the Project and Expanded Project. 3. All of the terms and conditions of the Agreement shall apply to this Amendment, the Expanded Project and the Second Encroachment Permit. IN WITNESS WHEREOF, the parties hereto have executed this Amendment as of the date first written above.
