RIGHT OF ENTRY <br /> WHEREAS, THE STONESON DEVELOPMENT CORPORATION is the owner of <br /> certain real property located on the west side of Interstate 580 <br /> in the City of Pleasanton, more fully described in Exhibit A <br /> attached hereto and incorporated herein; and <br /> WHEREAS, CITY OF PLEASANTON. desires to take an easement <br /> across.'that property for the purposes of installing a waterline; and * <br /> WHEREAS, CITY OF P.LEASANTON desires to enter and begin <br /> installing the waterline immediately, <br /> NOW, THEREFORE, THE PARTIES HERETO AGREEAS FOLLOWS: <br /> 1. The Stoneson Development Corporation grants permission to <br /> the City of Pleasanton, its agents, officers , contractors and assigns , <br /> to enter into and undertake construction work on the property de- <br /> scribed in Exhibit A, except as modified herein. <br /> 2. Exhibit A of the property shows a 15 foot service easement <br /> for a water line, That easement shall be reduced to 10-foot wide easement <br /> and the property description modified to that effect. <br /> 3. In the course of the City' s work, the City shall indemnify, <br /> hold harmless and defend The� Stoneson Development Corporation, <br /> its employees , officers and agents from any and all liability relat- <br /> ing to the installation of said water line. <br /> 4. City agrees to commence negotiations within a reasonable <br /> time for acquisition of an easement interest in the property subject <br /> to this right of entry. <br /> 5. The granting of this right of entry shall not waive any <br />
