l ti� /'rt <br /> AGREEMENT FOR INSTALLATION AND MAINTENANCE <br /> OF LANDSCAPING <br /> THIS AGREEMENT is made this lst day of December , <br /> 1977 , between St. Clare' s Episcopal Church , <br /> hereafter referred to as "Property Owner" and the CITY OF PLEASANTON, <br /> a municipal corporation, hereafter referred to as "City" . <br /> R E C I T A L S <br /> THIS AGREEMENT IS BASED UPON THE FOLLOWING FACTS: <br /> (1) Property owner is the owner of real property in the City of <br /> Pleasanton described in Exhibit "A" , attached to this Agreement and <br /> made a part of it by this reference; <br /> (2) On November 9 19 77 , the City _granted a <br /> design review approval to said property; <br /> (3) By the terms of the design review approval, property <br /> owner is required to install and maintain landscaping in accordance <br /> with a plan, to be approved by the Planning Department prior to Build- <br /> ing Permit approval; <br /> (4) Both parties recognize that the installation and maintenance <br /> of landscaping is an integral part of the property owner's plan for <br /> development of the property. <br /> NOW, THEREFORE , IT IS AGREED BETWEEN THE PARTIES, as follows: <br /> 1. Purpose . The purpose of this Agreement is to assure (a) <br /> installation in accordance with the landscaping plan previously <br /> approved by the City and (b) continued maintenance and care of the <br /> landscaping. <br /> t <br /> i <br />
