AGREEMENT is made this ~~~T "ay of , 1983 , <br />.between HOWARD C. HANSEN and ANN MARIE MIX (jointly "Owner"), <br />PONDEROSA HOMES, a general partnership ("Ponderosa") and <br />THE CITY OF PLEASANTON, a municipal corporation ("City"). <br />1. Owner will sell and convey to Ponderosa and Ponderosa <br />will purchase from Owner the parcels-described as A, B, and <br />D on Parcel Map No. 4014, as :prepared by Bissell & Kann, <br />Inc., Civil Engineers, April., 1983, a copy of which is attached <br />hereto, market Exhibit "A'', and made apart hereof by reference. <br />2. Ponderosa .has heretofore purchased and. acquired <br />from the .Dublin-.San Ramon Sewer District pursuant to the <br />1972 Settlement Agreement sewer. permits for utilization. in <br />connection with certain lands of Owner, which lands are <br />under option to purchase by Ponderosa, and which lands <br />- include, inter alia, Parcels A, B, and D described on Exhibit. <br />"A" hereto . <br />3. Ponderosa hereby covenants and agrees for itself, <br />its .successors and assigns, that in connection with the <br />development and improvement of Parcel A it will allocate and <br />utilize 125 purchased sewer permits; that in connection with <br />he development and improvement of Parcel B it will utilize <br />25 purchased sewer permits; and in connection with Parcel D <br />(addition to Cabana Club) it will, utilize no sewer permits. <br />j,7ithrespect. to Parcel C, not yet purchased from Owner, <br />-1- <br />
