STREET. `IMPROVEMENT AND RIGHT-OF-ti1AY AGREEMENT DEL VALLE PARKWAY FROM THE NORTH END OF THE PICO AVENUE BRIDGE TO THE EASTERLY BOUNDARY OF TRACT N0. 4401 THIS,~AG,REEMENT is made and entered. into this %~ t.~, day of ~~~~-, 1983, by and between FRANK AUF DER MAUR and KONRAD RIC~NBACH (hereinafter referred to as "Owners") and the CITY OF P'LEASANTON, a municipal cortioration, (hereinafter ref erred. to as "City") . T~THEREAS, Owners .owned roughly 74 acres of real property located on the south side of Stanley Boulevard, designated as all those lands within Parcel Map 1453, and Owners have been subdividing and developing this real property pursuant to final tract maps 3855, 41b6, and 4401;. and_ WHEREAS, the unsubdivided remainder of Owners` lands (all those lands within Parcel Map 1453 less those within Final Tract Maps 3858, 4166 and 4401) is shown in Exhibit "A" and is hereinafter referred to as the "Property,"and Owners intend to subdivide and develop the Property at some future date; and WHEREAS, development of Final Maps 440.1 and 4166 included dedication of and improvement of a portion of the Del Valle Parkway in accordance with standard City procedures and the City's plans and specifications for that roadway; and WHEREAS, the Property includes the proposed location of the Del Valle Parkway between the eastern line of Tract 4401 and the northerly terminus of the Pico Avenue .bridge, the -1-
